Termination of the Account for Terms Violation

System VPS Network may only be used for the purposes described in this section below. A serious breach of these Terms and Conditions will result in the immediate termination of the Subscriber’s account without prior warning or a refund if the Subscriber or any affiliate or subscriber of the Subscriber engages in any of the prohibited uses as described here.

Spamming

Spamming is not permitted, regardless of whether it overburdens the Services or impairs service to System VPS Network’s subscribers. The term “Spamming” refers to a variety of actions, including but not limited to sending bulk or commercial emails to unsubscribed recipients, keeping an open SMTP policy, and sending unsolicited emails for marketing purposes only (such as bulk cc or bcc lists). We don’t accept bought lists. Subscribers of System VPS Network are obligated to abide by the provisions of the Can Spam Act (http://www.ftc.gov/bcp/edu/pubs/business/ecommerce/bus61.shtm) and our own internal spam policies. System VPS Network maintains the right to evaluate whether email receivers fell under the bulk mail/spam categories in its sole and unrestricted discretion. Regardless of whether an email campaign falls under the definition of spam as set forth in this document, System VPS Network only permits a MAXIMUM of 100 emails per hour in general to be sent from any one hosting account. The hosting packages’ greater limits will apply to business high-speed accounts. This restriction is necessary to guarantee that our user can communicate with other servers via email without interruption. Since bulk mail frequently results in IP/Server blacklisting, other servers will refuse our messages as a result.

Email

On all of our servers, creating email forwarding (alise) to free email services like Gmail, Live, and others is not currently permitted. The likelihood that our users’ emails will be labelled as SPAM will increase if we choose a shared hosting solution with a large number of email forwarding to free email providers. To replace the auto forwarding service, you can configure Gmail to retrieve emails from our server.

Unacceptable Offers

No Subscriber shall use the Services for the purpose of providing, selling, or offering to sell any of the following: controlled substances, illegal drugs and drug contraband, weapons, pirated materials, instructions on how to make, put together, or obtain illegal goods or weapons to attack others, information used to infringe upon the copyrights of, infringe upon the trademarks of, or to destroy the intellectual property or information of others, information used to unlawfully harm any people or animals, pornography, nude photography,

Profanity

Both the domain name and the site’s content cannot contain any profanity or offensive language.

Images and private information

Without the permission of the subject (or, in the case of a minor, the authorization of the parent), subscribers are not permitted to post or disclose any personal or private information about or photos of minors or any other third party.

Intellectual property rights violations

Any infringement on a person’s or an organization’s intellectual property rights, privacy rights, publicity rights, or other personal rights is forbidden. Upon receiving valid notice of a copyright infringement, System VPS is required by law to remove or disable access to the content that is accessible through or on the Services (see “Copyright Infringement Notice Information” below).

Providing false information about a transmission

It is against the law to fabricate, distort, omit, or delete message headers, return mailing details, and/or Internet protocol addresses in an effort to hide or falsely identify a communication’s origin.

Viruses and other harmful practices

It is forbidden to use the Services to launch denial-of-service attacks, create or send Internet viruses, worms, or Trojan horses, or to ping, flood, or mail bomb. Any Subscriber who engages in any other action that is intended to interfere with, or actually interferes with, the ability of others to successfully use the Services (or any associated network, system, service, or equipment) or do business online is likewise forbidden from doing so.

Hacking. Hacking and other practices are forbidden

“Hacking” includes, but is not limited to, the following actions: accessing computers, accounts, or networks illegally or without authorisation; breaching or attempting to breach security measures; port scans; stealth scans; and other actions intended to help with hacking.

Untraceable Proxies

On its servers, System VPS prohibits the usage of anonymous proxy scripts. All users on that server may be impacted by their severe resource abuse of the service.

Violations of export controls

It is against the law to export encryption software outside of the United States or Malaysia, as well as to break any export laws that may apply. Without abiding by all applicable statutes, codes, ordnances, regulations, and rules imposed by U.S. federal, state, or local law as well as Malaysia law, or by any other applicable law, Subscriber is not permitted to export or transfer, directly or indirectly, any regulated product or information to anyone outside the United States/Malaysia.

Child Pornography

It is forbidden to save, post, display, transmit, market, or otherwise make child pornography available through the Services. As required by law, System VPS will alert law enforcement officials when it discovers child pornography on the Services or being transferred through them.

Additional Illegal Activity

It is not permitted to use the Services for any action that System VPS Network deems to be unlawful in its sole and unfettered discretion. Ponzi or pyramid schemes are only a few examples of unlawful behaviours that fall under this category. Others include charging someone else’s credit card fraudulently or disclosing their credit card information without their permission, as well as failing to adhere to any online privacy regulations. In regards to any and all illegal activity taking place on or via the Services, System VPS Network will fully cooperate with the relevant law enforcement organizations.

Language that is offensive, defamatory, abusive, or threatening

It is against the law to use the Services to store, post, transmit, display, or otherwise make available any anything that is offensive, defamatory, harassing, abusive, or threatening.

DUPLICATE STORAGE

System VPS Network DOES NOT OFFER ITS SERVICES TO STORE DATA, BUT TO HOST WEBSITES. IT IS PROHIBITED TO USE AN ACCOUNT AS AN ONLINE STORAGE SPACE FOR ARCHIVING ELECTRONIC FILES, AND DOING SO WILL RESULT IN AN IMMEDIATE TERMINATION OF HOSTING SERVICES.

Additional Activities

It is forbidden to engage in any activity that System VPS Network, in its sole and unassailable discretion, believes to be harmful to (or poses a threat of being harmful to) the Services, System VPS’s operations, business, reputation, goodwill, subscribers and/or subscriber relationships, or the ability of System VPS’s subscribers to efficiently use the Services. Making any programme, product, or service available that is intended to violate these terms and conditions or that could be used to do so is among these forbidden acts. Additionally, a violation of these Terms and Conditions by the Subscriber occurs when the Subscriber refuses to assist System VPS Network in resolving or preventing violations of these Terms and Conditions by, or that arise from the behaviour of, a Subscriber’s subscriber, patron, customer, invitee, visitor, or guest.
